The battle between Epic Games and Apple continues to rage on. Despite being found in violation of an injunction given by the court, and effectively being told they must immediately stop imposing commissions or fees on customer App Store purchases, Apple is continuing to refuse to allow Fortnite back on its App Store. The injunction was believed by many, including Epic Games, to be an adequate sign that the law sides with Epic and Fortnite‘s right to be on the Apple App Store for iOS devices.
The news was shared by Tim Sweeney, the CEO of Epic Games, who posted over on X (formerly Twitter) a new court document that shows a judge questioning why Apple isn’t following the order and allowing Fortnite to return to the App Store, after it broke the rules (that the court now determine were wrongful) back in 2020. This document orders Apple must respond this week explaining why they are still shutting out Fortnite, and should the issue not be resolved this week, a hearing will take place on May 27 to allow both parties to plead their cases further.
Sweeney says in his own words that Apple have stated their intentions to ignore the Fortnite App Store submission until after this new discussion is had later this month, with the potential to run into June as well. Apple may have given into court orders with other app developers, but they’re going to block out Fortnite from the App Store for as long as they can until conceding defeat, and that seemingly won’t be any time soon.
